Update ni Bokal Lyn sa Nevada case; Posisyon ng Macec at affected communities

 UPDATE ON THE NEVADA CASE:  (ni Adeline Lyn Angeles)

March 5, 2014- Matapos ang ilang buwan na pormal na naka-refer ang isyung ito sa SP Committee on Environmental Protection, sa Committee Report (signed by Board Members Ricohermoso, Caballes, Nepomuceno, Fabrero) na sinumite sa SP, nirekomenda ng Komite na ang isyung ito ay i-refer sa Committee of the Whole. Ibig sabihin ang lahat ng mga bokal na acting as 1 committee and chaired by the Vice Gov ang mangunguna na sa pag-aaral ng isyung ito. 

Wala naman sanang problema na Comm of the Whole na ang humawak sa insyung ito. In fact, dapat lng tlaga dahil maselan ang bagay na to. Sana nga lang, mas maaga itong binitiwan ng Committee on Envi Protection para mas maayos at maagang nakagalaw ang Commitee of the Whole para dito. Ngayon, meron na lamang natitirang 7 working days para ito desisyunan. Marami pang dapat at kailangang gawin to make informed decision but 7 days is already very limiting. This matter has been in the SP Committee of Envi Protection since November 2013 para pag-aralan. I personally waited for their substantial recommendation. Just sad that after months of being in-charged, the recommendation is for the Committee of the Whole to take charge na. And in 7 working days, we will try to accomplish what could have been done months ago. 


Also in yesterday's session, there was an attempt to stop me from giving my comments on the report and processes undertaken. Good they conceeded at the end and the Presiding Officer allowed me to register my comments. 

I always maintain diplomacy and observe professionalism in my work and in dealing with colleagues. But this is one moment when i know i already raised my voice . I will never allow any act that deprives me of a reasonable exercise of my rights and official function. Because in my mind, it is not just my right as Lyn Angeles that is at stake here but the rights of all who trusted me and the people whom i am representing in that session hall. Wala akong material favors na naibibigay sa tao sa panahon ng eleksyon. Ito lang ang pwede kong ipalit sa pagtitiwala nila. Miserere Nobis!!!2

I would not mind for the case to stall by virtue of rejecting the settlement offer in its entirety. So much time has been lost in the legal battle for almost no gain, but a miserly $13M net for the province. Going back to square one is much preferable, would allow a better opportunity to restudy the case with stronger data support than was offered earlier by the Counsel, and re-represent to the U.S. Court. Forget about the fear-mongering campaign being launched by the Counsel's Team that Barrick is losing money and that the US Court is no longer open to accommodating international environment and human rights cases. I'm confident that finding a better qualified legal team, passionate and competent enough on the issues we are fighting for, we stand to reap better rewards than the rotten current undignified offer.


Macec Marinduque ... noong September 11, 2013 consultation umattend kami, marami kaming leaders doon, and they are about to decide sana noon dahil sabi nga ng abugado ay take it or leave it, pero noong nireveal ang mga terms and conditions na hindi natin kayang sikmuraing tanggapin ay siyempre marami ang tumutol kaya hindi nakapagdesisyon,mula noon ay nagkaroon na kami ng massive consultation sa mga communities at siyempre pa galit ang mga tao lalo na ang mga plaintiffs natin sa mga kasong naifile sa tulong ng MaCEC. Marami ng mga position paper at mga resolution na nagbibigay ng mga puna, paninindigan at mga rekomendasyon pero mukhang hindi nacoconsider - dahil di ba wala pa ngang report ang committee on Ecology at ipinasa pa nila ito ngayon sa kabuuhan ng SP para pagaralan. Recently, nagpatawag sila ng consultations daw - si Sec Neric Acosta at Atty.Harry Roque ang speakers pero di kami nakadalo, ayon sa reading ng mga dumalo - they are helping the province to convince and influence the LGUs & the people to accept the settlement offer na para bang sukol na at wala ng ibang option, buo na din ang position ng mga affected communities - kung ganyang klase ang settlement offer, ay itigila na ang negosasyon at ituloy na ang pagdinig sa mga kaso.



(Translation: ... we attended the consultatative meeting on Sept. 11, 2013, and they were about to decide then because the lawyer said take it or leave it, but when the terms and conditions were revealed, that we could not stomach to accept, of course many were against it and no decision was made, from then on we held a massive consultation with the communities and, of course, the people were angry particularly our plaintiffs who filed cases with MaCEC's help. There have been many position papers and resolutions that are critical, giving their stand and recommendations but it looks like they are not being considered - because, isn't it so that the committee on Ecology has not made a report yet, and now they even passed it on to the SP committee of the Whole for study. Recently, they called for a so-called consultation - Sec Neric Acosta and Atty Harry Roque were the speakers but we were not able to attend. According to the reading of those who attended - they are helping the province to convince and influence the LGU & the people to accept the settlement offer as if it is the end of it and there is no other option. The position of the affected communities stands  - if that is the kind of settlement they are offering, they should stop the negotiation and just continue with the litigation.)
