Desisyon ng Korte Suprema sa mandamus case wala sa kapasyahan ng speaker


"Nakalipas na ang matagal na panahon para tanggapin na ng mga kinauukulan kung ano ang mga kasong dininig at tanggapin din ang judicial notice sa katotohanan na hindi karapat-dapat na tumakbo at mahalal sa tinatakbuhang posisyon si Regina Ongsiako Reyes, dahil ito ay matagal nang ipinagtibay ng Korteng ito. Ano mang kapasyahan na taliwas sa nasabing ipinagtibay nang kapasyanan ay hindi magiging sang-ayon sa Rule of Law at hindi dapat pahintulutan."

ULAT:

Ang Korte Suprema ay nagpasya na na ang panunumpa ni Rep. Lord Allan Jay Q. Veasco at pagrehistro ng kanyang pangalan sa Roll of Members of the House of Representative para sa tanging distrito ng Marinduque "ay wala na sa kagustuhan o kapasyahan" sa panig ni House Speaker Feliciano R. Belmonte Jr.

Ito ay idiniin ng SC sa "immediately executory" nitong desisyon na nag-aatas kay Belmonte na panumpain niya ng oath of office si Velasco, at pag-uutos kay House Secretary General Marilyn B. Barua na irehistro ang pangalan ni Velasco bilang miyembro ng Kongreso.

Sa 8-1 na desisyon na isinulat ni Justice Teresita J. Leonardo de Castro, na ang  opisyal na kopya ay inilabas ng SC kahapon, sinabi ng Kataas-taasang Hukom na:

"Nakalipas na ang matagal na panahon para tanggapin na ng mga kinauukulan kung ano ang mga kasong dininig at tanggapin din ang judicial notice sa katotohanan na hindi karapat-dapat na tumakbo at mahalal sa tinatakbuhang posisyon si Regina Ongsiako Reyes, dahil ito ay matagal nang ipinagtibay ng Korteng ito. Ano mang kapasyahan na taliwas sa nasabing ipinagtibay nang kapasyanan ay hindi magiging sang-ayon sa Rule of Law at hindi dapat pahintulutan." 

“It is well past the time for everyone concerned to accept what has been adjudicated and take judicial notice of the fact that Regina Ongsiako Reyes’ ineligibility to run for and be elected to the subject position had already been long affirmed by this Court. Any ruling deviating from such established ruling will be contrary to the Rule of Law and should not be countenanced.”

Ayon sa SC si Speaker Belmonte ay opisyal nang nabigyan ng kopya ng desisyon. Sa pagdating ng katanghalian kahapon ay wala pang oath-taking na nakatakda para kay Velasco.

Sa pag-bigay ng ruling na naaayon sa petisyon for mandamus ni Velasco, sinabi ng SC na "wala nang anumang usapin sa kung sino ang karapat-dapat na representante ng lone district of Marinduque", dahil sa finality ng desisyon nito kung saan ipinagtibay ang kapasyahan ng Commission on Elections (Comelec), 
na "tama sa pagkansela ng certificate of candidacy (COC), ni Reyes bilang miyembro ng House of Representatives sa kadahilanang siya ay "ineligible" sa nasabing posisyon dahil sa kanyang kabiguang patunayan ang kanyang Filipino citizenship at sa kinakailangang one-year residency in the province of Marinduque."

Ang Mandamus ay isang special civil action na, kasama pa ang ilan pang mga bagay, "ay sakop ang mga sitwasyon na kung saan ay labag sa batas na ihinihiwalay ang iba mula sa pag-gamit o matamasa ang isang karapatan o posisyon kung saan siya ay may karapatan..." 

“By virtue of Comelec en banc resolution dated May 14, 2013, in SPA No. 13-053; certificate of finality dated June 5, 2013 in SPA No. 13-053; Comelec en banc resolution dated June 19, 2013, in SPC N. 13-010; Comelec en banc resolution dated July 10, 2013 in SPA No. 13-053; and Velasco’s certificate of proclamation dated July 16, 2013, Velasco is the rightful representative of the lone district of the province of Marinduque; hence, entitled to a writ of Mandamus,” the SC ruled.

Limang "undisputed facts" ang binanggit ng SC na magpapatunay sa karapatan ni Velasco sa pagpapalabas ng mandamus. Ang mga ito ay:

1. "Sa panahong iprinoklama si Reyes, ang kanyang COC ay kinansela na ng Comelec an banc sa final finding nito sa resolution noong Mayo 14, 2013, ang effectivity nito ay hindi naman idinaan sa Korteng ito dahil hindi naman ginawa ni Reyes ang prescribed remedy... "

1. “At the time of Reyes’ proclamation, her COC was already cancelled by the Comelec en banc in its final finding in its resolution dated May 14, 2013, the effectivity of which was not enjoined by this Court, as Reyes did not avail of the prescribed remedy….”

2. "Kinatigan ng Korteng ito ang kapasyahan ng COmelec na nag-kakansela sa COC ni repondent Reyes sa resolusyon nito na may petsang June 25, 2013, at October 22, 2013, at ang mga resolusyon na ito ay final at executory"

2.  “This Court upheld the Comelec decision cancelling respondent Reyes’ COC in its resolutions of June 25, 2013, and October 22, 2013, and these resolutions are already final and executory.”

3. Bilang resulta ng mga pangyayaring ito, ang Comelec sa SPC No. 13-010 ay nagkansela sa proklamasyon ni repondent Reyes at, iprinoklama naman si Velasco bilang duly elected member ng House of Representatives para sa lone district of the province of Marinduque. Ang nasabing proklamasyon ay hindi kailanman tinutulan ni Reyes sa alin mang proceeding." 

3. “As a consequence of the above events, the Comelec in SPC No. 13-010 cancelled respondent Reyes’ proclamation and, in turn, proclaimed Velasco as the duly elected member of the House of Representatives in representation of the lone district of the province of Marinduque. The said proclamation has not been challenged or questioned by Reyes in any proceeding.”

4. Nang manumpa si Reyes ng kanyang oath of office sa harap ni respondent Speaker Belmonte Jr. sa open session, walang balidong COC o balidong proklamasyon si Reyes.

4.  “When Reyes took her oath of office before respondent Speaker Belmonte Jr. in open session, Reyes had no valid COC nor a valid proclamation.”

5. "Dahil sa mga naisaad na sa itaas, si Reyes ay sadyang (absolutely), walang legal na basehan para manilbihan bilang miyembro ng House of Representatives para sa lone district of the province of Marinduque, at kaya, wala siyang legal na personalidad para kilalanin bilang party-respondent sa quo warranto proceeding sa HRET."

5.  “In view of the foregoing, Reyes has absolutely no legal basis to serve as member of the House of Representatives for the lone district of the province of Marinduque, and therefore, she has no legal personality to be recognized as a party-respondent at the quo warranto proceeding before the HRET.”
