Kasaysayan ng mapanlinlang na utang at kinalaman nito sa eleksiyon

Madali kitang makalimot ay, kaya balikan natin at paala-ala lemeng sa mga nakaraang kaganapan...

AUGUST to OCTOBER 2012 - Dahil sa pabago-bagong resolusyon ng Sangguniang Panlalawigan ng Marinduque, lumitaw na walang maliwanag na ideya ang SP kung magkano ang pinupuntiryang uutangin sa bangko at wala ring ideya kung saan nila ibig gastahin ito. 

Unang kapasyahan ay P300M, binawasan at ginawang P250M, at sa huli ay ginawang P150M (para raw sa pagpapagawa ng airport runway, P100M; at para sa farm-to-market roads ay P50M). 

Binigyang diin ng Gobernadora na kailangan daw ipagawa ang airport runway na responsibilidad naman at pinondohan na ng DOTC at CAAP. September 12, 2012 ay kinumpirma na sa sulat ng DOTC kay Cong. Velasco ang nakalaang pondo. Iginiit naman ng gobernadora na kapitolyo ang magpapagawa at sisingilin na lamang ang DOTC, taliwas sa sinusunod na mga patakaran ng pamahalaan.

Nagpasa ng Resolution No. 2012-12 Oct. 20, 2012 ang MARINDUQUE MOVERS bilang pagtuligsa at paglaban sa hakbangin ng kapitolyo para mangutang dahil sa nabanggit na mga kadahilanan. Sinusugan naman ito ng Sangguniang Bayan ng Boac na nagpasa rin ng resolusyon para hadlangan din ito.

Para bigyang diin ang panlilinlang na ginagawa sa taumbayan, inihayag ng Marinduque Movers ang sadyang hindi pagsunod sa mga patakaran ng SP, tulad ng hindi pagpapaalam sa minority group. Anang Movers: "it was not discussed nor presented formally as the proponent has not submitted any financial feasibility study and program of works for the proposed projects, and, most notably without the endorsement of the Treasurer, Accountant, PPDO, and most importantly the Provincial Development Council, and its approval was allegedly railroaded.” 

Dagdag pa nito: “the flip-flopping SP Resolutions only show how the proponent of the loan has no clear idea on the exact amount they need and it follows that they do not have, again, a clear idea on what projects are to be undertaken”.

FEBRUARY 2013: Tumahimik muna ang kapitolyo, subalit tatlong buwan bago dumating ang Eleksyon 2013, biglang binuhay na naman ang gustong gawing pangungutang.

Dahil bistado na kung saan talaga gustong gamitin ang utang, nagsampa ng injunction case sa Marinduque RTC ang Marinduque Movers laban sa provincial government at Philippine National Bank (PNB). Iminungkahi at pinayagan ng Korte na isama ang mga mayor ng Sta. Cruz, Boac, Gasan at Buenavista bilang mga nagrereklamo rin, o plaintiffs. Pumirma rin ang 1,465 referendum petitioners na lumaban sa pakau ng kapitolyo.

Binansagan ng abogado ng Movers, Atty. Benjo Buenviaje, ang pangungutang na isang masamang hakbang "sinister (evil) measure". 

At tila nanahimik muli ang provincial government.

FEBRUARY 2014: Pormal na humiling sa SP ang Gobernadora ng Marinduque na bigyan siya ng awtoridad na makipag-negotiate sa Land Bank of the Philippines (Landbank) para mangutang ng P500M naman.

Umalma naman ang Sangguniang Panlalawigan. Sa kanilang pag-aaral na pormal na nakasaad sa kanilang Joint Committee Report No. 21-2014 petsa May 14, 2014, ay bahagi ng kanilang sinabi ang ganito:

- Ang gustong utangin ay P 500-million, pero kapag isinuma-total ang paglalaanan ay may discrepancy kaagad na P 50-million (P 250-M sa farm-to-market roads/provincial roads; P 75-M para sa heavy equipment; P 50-million para sa waterworks; P 75-M para sa other priority projects like sports complex at tourism - Total P 450-M).

Ilan pa rin sa dapat pansinin na bahagi ng nasabing Joint Committee Report ay ang sumusunod:

- Base sa report ng provincial engineer, ang isang kilometro ng konkretong daan ay magkakahalaga ng P 6-million; kinumpirma ng engineer ang pangangailangan sa heavy equipment para sa pagpapagawa at maintenance ng mga kalsada. 

- May nakalaan nang P 77-million para sa infrastructure development mula sa 20% Developmet Fund-Annual Investment Program pero ayon sa provincial engineer, ang P14-million na nakalaan para sa PEO ay hindi ginagamit dahil si Honorable Congresswoman Gina Reyes ay naka-secure na ng funding assistance mula sa national government na nagkakahalaga ng P 214-million para sa pagpapagawa ng farm-to-market roads.

Ito ang eksaktong nakasaad sa nabanggit na Report tungkol dito:

The Provincial Government has allocated a total of P 77-Million for infrastructure development under the 20% Development Fund - Annual Investment Program. Out of this according to the Provincial Engineer, only P 14-Million were under the Provincial Engineering Office, and this amount is not being utilized since the Honorable Congresswoman Gina Reyes has secured funding assistance from the National Government amounting to P 214 Million which will be used for the construction of Farm-to-Market roads.

Ang laman ng Joint Committee Report na nabanggit ay pormal na inadopt ng SP sa Resolution No. 318 Series 2014 (May 14, 2014).

Sa hindi malamang dahilan, nasundan ito ng matagal at misteryosong katahimikan.

OCTOBER 2015: Bumulaga ang bagong panggulat! Proposed loan na naman pero luto na. Sumusunod ang bahagi ng aking blog noong October 14, 2015, na ang titulo ay 'Marinduque racing for resurrection of pre-election P 300-M loan; missing funds?':

Isinasagawa na naman ngayon nang mabilisan matapos ang matagal na pananahimik, ang panibagong pangungutang ng P 300-Milyon ng Kapitolyo ng Marinduque sa Development Bank of the Philippines (DBP) naman. (Dahil sumablay yung sa PNB at Landbank na naunang mga target).

Sa isang pulitikal na pamiting sa Sta. Cruz kamakailan, may kinalaman sa parating na eleksyon at dinaluhan ng mga barangay captains ay panay ang pagbibida ng isang opisyal ng Kapitolyo sa mga Kapitan na aprubado na aniya ng bangko ang halagang P 300-M na uutangin at babayaran ng probinsya sa loob ng 13 taon. 

Tatrabahuhin na lamang ang pagsasaayos ng mga papeles, quiet lang kayo. "Basta may maaasahan na tayo", sabi pa nga raw. 

Naalaala ko tuloy yung isang blog ko noong September 8, 2012:

But are they engaged now in a race at troubleshooting of some sort to legalize their blunders? (Sins?) Of course, there’d be arguments that no official agreement has been signed yet, nothing’s been ratified yet by the SP. But shall we just throw up our hands in frustration, or just simply throw up, and there… they go?

...So they now in fact, and very soon for the rest, will go the rounds of the campaign trail, while we watch them laugh, tickled to the bone for getting away with their sinister deeds. 

Just like a walk in the park, it is, plotting to conduct and promote baluktot na daan, in direct defiance of Pnoy’s ‘tuwid na daan’, towards what is now seen as potentially the craziest, most expensive Marinduque election campaign of all time?

Then, Gov. Carmencita Reyes signed a 10-year P 300-M loan contract with DBP on Oct. 20, 2015, or 12 days after she was ordered suspended for 60 days by Sandiganbayan in relation to her alleged involvement in the P728-million fertilizer fund scam.

The said loan contract was signed in the midst of questions from some SP members like 'what loan is that?', 'where are the necessary pre-loan documents we have requested a long time ago for the customary studies?', etc. etc.

JANUARY 2016: May report mula sa Philippine Daily Inquirer:

A group of taxpayers has asked the Makati Regional Trial Court (RTC) to nullify a P300-million loan deal entered into by the provincial government of Marinduque with the Development Bank of the Philippines (DBP), saying the beneficiary projects have already been funded by national government agencies.

In an 11-page petition filed on Dec. 28 last year in the Makati RTC Branch 145, the group sought the issuance of an injunction order to prevent the release of the fund.

The petitioners included former Marinduque Gov. Aristeo M. Lecaroz; former Mayor Pedrito Nepomuceno of Boac town, Marinduque; retired Philippine National Police chief Recaredo Sarmiento II; Eliseo J. Obligacion and Milton Mendoza.

Dinidinig pa rin ang kasong ito hanggang sa kasalukuyan.

Malalim na pagtatanong, pag-iisip

Napakahaba na po ng listahan ng Commission on Audit (COA) tungkol sa mga anomalyang nagaganap sangkot ang milyon-milyong pisong pondo sa loob ng kapitolyo ng Marinduque nitong mga nakaraang taon. Basahin dito, dito, dito at dito.

Panahon na para sa makabuluhang pagtatanong at malalim na pag-iisip ang mga magigiting na mga kababayang Marinduqueno kung dapat pang patagalin ang tila walang humpay at walang katapusang mga anomalya at corrupt practices na ito gamit ang kaban ng bayan.

Aba si FPJ ang nagsabi at nakatatak na rin sa puso ng mga Filipino, higit sa mga Marinduqueno na: "Kapag puno na ang salop, kailangan ng kalusin!"

Ihinalintulad ang inuutang sa bangko na P 500-Million ng kapitolyo ng Marinduque sa nadeklara nang labag sa Konstitusyong PDAF fund allocation. Matatandaang nanawagan na rin kamakailan ang Commission on Audit (COA), sa lokal na pamahalaan ng Marinduque na ang pagtitipid sa development funds ay hindi kapakipakinabang para sa mga nasasakupan nito. 

Kasunod ito ng pagbatikos ng COA sa lalawigan dahil bukod pa sa mga maanomalyang mga transaksyon na inisa-isa ng Commission sa COA Report 2013, higit sa P 100-Million na pondo ng Kapitolyo pala ang hindi nito ginagalaw, "gayung maraming proyekto sa ilalim ng Annual Investment Plan ang dapat na ipatupad". Ayon pa rin sa COA nagresulta ito sa kabiguan ng Marinduque na magpatupad ng "“desirable socio-economic development and environmental management outcomes” na anila'y dapat sanay nakapagbigay ng mga trabaho at kabuhayan para sa mga taga-Marinduque.

Ilan lamang ito sa mga bagay na ipinaalam ni dating Bokal at Boac Mayor Pedrito Nepomuceno sa Sangguniang Panlalawigan ng Marinduque sa pamamagitan ni Vice-Governor Romulo Bacorro, Jr.

Matatandaang sa 2013 annual audit report para sa lalawigan, binatikos din ng COA ang mga opisyales ng pamahalaan dahil sa pag-aatubili nito na kolektahin ang hindi binabayarang amelyar ng isang minahan sa loob ng mahabang panahon, sa kabila ng katotohanang may desisyon na hinggil dito ang Korte Suprema.

Sa isang bahagi pa lamang ng minahan, anang COA, partikular sa siltation and decant system nito at sa lupa kung saan nakatayo ang nasabing mga instruktura ay mahigit sa P 19-million ang utang ng Marcopper. Hindi kasama rito ang amelyar ng minahan sa lahat ng lupang pag-aari nito sa iba't-ibang bayan ng Marinduque na umabot na sa isang bilyong piso (P 1-Billion).

Binigyang diin ni Nepomuceno na hindi kailangan ng lalawigang mangutang dahil may sapat itong pananalapi. Bukod pa aniya sa hindi kinokolektang buwis para pondohan ang mga proyekto, ay maraming mapapagkunang pondo ang lalawigan mula sa nasyunal na pamahalaan, kasama na ang IRA.

Mauulit ang naunang protesta

Pinaalalahanan ni Nepomuceno ang Sangguniang Panlalawigan tungkol sa naunang pagprotesta na isinagawa ng Marinduque First Saturday Movers (Marinduque Movers), at ilang bayan ng Marinduque sa pangungutang ng Marinduque noong 2012. Aniya, binalak utangin sana noong taong 2012 ang pagpapasaayos ng runway sa paliparan ng Marinduque, pagpapagawa ng sports center, legislative building at iba pang mga estruktura. Ayon kay Nepomuceno, ang mga ito ay naisagawa at patuloy na isinasagawa mula sa pondo na nanggaling sa nasyunal na pamahalaan na siyang marapat, "at hindi dahil sa pangungutang". 

"One Heart. One Mind. One Marinduque"

Si Nepomuceno ay isang kasapi ng Marinduque Movers. Matatandaang isa rin siya sa mga opisyal na naghain ng petition sa Korte Suprema para ideklarang unconstitutional ang PDAF.

Sinabi rin ng dating Bokal na kung ang lalawigan ay nakakagastos aniya ng higit sa P 7-million para sa mga pakain na may kinalaman sa Morion at sports na naiulat din ng COA, bakit hindi nito kayang gumastos para sa pagpapasaayos ng mga provincial roads?

Nangyayari aniya ang ganitong pangungutang tuwing nalalapit ang halalan, kayat lagi ding kahinahinala ang tunay na motibo ng pamahalaang panlalawigan. Binigyang diin ni Nepomuceno, na kapag iginiit ng kinauukulan ang nasabing pangungutang ay maaaring isagawa muli ng Movers ang pormal na pagtutol dito at dalhin ang usapin sa Tanggapan ng Ombudsman.

"I appeal to your sense of patriotism, do not pursue the loan as it will contribute to the further distortion of our finances. Our loyalty must be for our country and our people and not on the powers that be," ang nakasaad sa sulat ni Nepomuceno.

"Brother Vice Governor Jun Bacorro, may I respectfully request you to be a true leader as we were taught in APO. Do what is good for our constituents and not be blindly swayed to the promise of a traditional play in Philippine politics. We all know there is always something on it and all of us must oppose it", patuloy pa niya.

Sa isang hiwalay namang pagkilos, napag-alamang nagsagawa na rin ng isang pormal na resolusyon para sa mga kinauukulan ang nasabing organisasyon ng Marinduque Movers hinggil sa kontrobersiyal na pangungutang na nabanggit.

Sa paglapit ng Kampanyahan sa Eleksiyon, nangungutang ng kalahating Bilyon ang Kapitolyo ng Marinduque for infra na naman kuno!

Dahil diumano nahihirapan na silang mga nasa poder na diktahan ang ilang ahensya ng pamahalaan tulad ng DPWH sa pag-award ng infrastructure projects - dahil ang desisyon na ito ay hawak na ngayon ng Regional Offices, para mabawasan daw ang CORRUPTION sa local level,  kailangan namang gumawa ng para-paraan silang sanay na sa bulok na kalakaran sa gobyerno para makapag-ipon ng limpak-limpak na salapi para sa darating na eleksiyon atbp.

Noong 2013, mariing tinutulan ng Civil Society Orgs (tulad ng Marinduque Movers) at ilang LGUs ang binalak na pangungutang ng Kapitolyo ng Marinduque sa bangko sa halagang P 150-Million na sa opisyal na dokumento naman ay lumobo sa P 300-Million. Kailangan daw ang ganoong halaga para sa pagpagawa ng airport, at iba pang imprastruktura sa Marinduque.

Idiniin ng Movers noon na ang mga ganitong proyekto ay may mga kaukulang pondong nakalaan mula sa national government tulad ng PDAF at iba pang pondong mula mismo sa mga kaukulang ahensya ng pamahalaan. Malakas naman ang usap-usapan na tulad ng nakagawian na, mga infra projects ang pinakamadaling pagkunan ng pondo at komisyon kapag malapit na ang eleksyon.

Hindi itinuloy ang pangungutang dahil sa mga protesta. Subalit natuloy naman ang pagpapagawa ng Marinduque Airport (na ginagawa pa rin kahit may mga kamay na ayaw ipagpatuloy nito dahil diumano sa hindi pagiging alyado ng nakipagkontrata sa nasa poder, samakatuwid anila ay dahil "walang delihensya"). 

Natuloy ang pagpapagawa ng mga kaukulang istruktura dahil nga sa nakalaan nang pondo mula sa national government at hindi dahil sa pangungutang. Yun nga lamang, ayon sa COA REPORT CY 2013, maanomalya ang ilan sa mga infra projects na isinagawa at pinapabalik na ang ilang milyong pisong maanumalyang pondo matapos ma-audit. Ngayon naman, lingid sa kaalaman ng publiko, may P 500-MILLION na UTANG ang inilalakad ng Kapitolyo ng Marinduque sa kaukulang Bangko para din sa "Infrastructure projects" na balak ipatupad sa panahon ng kampanyahan sa Eleksyon tulad ng dati. Kopya ng SP Resolution sa itaas).

FLASHBACK SEPTEMBER 8, 2012 (Marinduque Rising):

What again is the P300M loan for?

Reyes: “Third, that’s for a Sports Complex. Many LGUs have obtained bank loans to promote tourism in their area..(blah-blah-blah).”

Reyes: “Fourth, that’s for Education. Pareng Edmund’s scholarship program must be revived…” 

The script dictates that the people of Marinduque must never be given the impression that the scholarship program of their perceived political enemy is working, and working well, openly admitted by a high ranking school official of the state college, for one, as the ‘biggest number of scholars granted to their students in the school’s history’.

Reviving a son’s previous scholarship program at the approach of elections to the extent that a provincial loan must be obtained simply sounds outrageous. Nonetheless, such Reyes scholarships are now being distributed out of capitol funds at the Reyes residence in the Boac Poblacion to college recipients who must be accompanied by immediate family members (who must be political supporters), in receiving the cash as shown in this photo taken Aug. 29, 2012:

What about the Php 300-million Term Loan with PNB?

Reyes said: “That’s just a Credit Line for P300M, we will only borrow what we need (sang-ayon sa kakailanganin lamang); the rest of the amount will be used only as “paghahanda, contingency, kung sakaling hindi makapaglabas ng pananalapi ang DOTC (for airport runway); “Opisyal na ipinahatid ng pamunuan ng PNB ang kanilang kahandaan na pagkalooban ang Lalawigan ng Marinduque ng Credit Line…”

But, in the first place, was the Governor of Marinduque authorized to negotiate for the amount (P300M), she proudly confirmed over the radio, when in fact the Sangguniang Panlalawigan of Marinduque in its original resolution specified the amount of P250-M, later amending it to P150-M as broadcast over the radio and confirmed by the Bokales, with a sudden shift in purpose when a public outcry got louder?

Remember that the SP initially specified that the loan is for ‘road network infrastructure development project’, then altered the words through a new resolution to ‘road network infrastructure projects and for other priority socio-economic development programs’, then deciding to alter it again to just ‘P100M for Marinduque Airport Runway and P50M for farm-to-market roads.’ Topsy-turvy flip-flops, and there’s more!

Are these tell-tale signs of an abnormal and nervous rush to just produce crispy moolah for election campaign purposes? Re-elections must be guaranteed with money changing hands as early as now; the filing of certificates of candidacy comes in just a month from now, as we know. And, it’s probably really difficult to turn down an alleged P1-M (in CDF?) for each Bokal once the loan is consummated?

FLASHBACK, FEBRUARY 8, 2013, (Marinduque Rising):

With three months to go before the national and local elections, and even as the Department of Transportation and Communications (DOTC) has approved a P100-M grant for development of airports that include the Marinduque Airport (see article below), the administration of Gov. Carmencita O. Reyes is still pushing for a term loan with Philippine National Bank (PNB), for the very same project for which P100-M has been earmarked.

In Resolution No. 865 series 2013 the Sangguniang Panlalawigan reaffirmed the intention of the Provincial Government to pursue the loan "notwithstanding the objection of some sectors".

It will be recalled that in October last year the Marinduque NGO, Marinduque First Saturday Movers (Marinduque Movers), protested the loan proposal through a resolution. The said resolution stated that "the flip-flopping SP Resolution only shows how the proponent of the loan (Provincial Government of Marinduque), has no clear idea on the exact amount they need and it follows that they do not have, again, a clear idea on what projects are to be undertaken". The group added that "the repair of airport runway is a national government concern and repairs should be undertaken by the DOTC and not by the Local Government. Read

Capitol's PNB Loan 'sinister measure' further opposed

Previous post is about DOTC's approval of a grant for the development of the Marinduque Airport, the same project that the Provincial Government of Marinduque under Gov. Carmencita O. Reyes appears bent on pursuing. This is occuring inspite of prior statements already made by the DOTC and the Civil Aviation Authority of the Philippines (CAAP) confirming allocation of appropriate grants to complete the said airport. Atty. Benjo R. Buenviaje of Sta. Cruz, Marinduque made a response on the article through his facebook account.

Atty. Buenviaje serves as legal counsel on the case for Marinduque First Saturday Movers, Inc. an NGO at the forefront of moves to oppose the 'flip-flopping resolutions' issued by the Sangguniang Panlalawigan to justify the loan. Buenviaje, in his facebook account posted his comment, reproduced below with some friend-comments.

PNB had earlier given the provincial government up to December 31, 2012 to contract the said term loan for the specified amount of P300-Million or twice the SP approved amount of P300-Million. With three months before the elections in May, the loan proposal has been resurrected by the Reyes administration. In his facebook account Buenviaje states that 'the group already initiated an injunction case against the provincial government and the PNB before the Regional Trial Court of Marinduque. 

"The case became even stronger when the court recently granted my motion to have the mayors of Sta. Cruz, Boac, Gasan and Buenavista be impleaded as party plaintiffs", Buenviaje stated in his post.

We already initiated an injunction case against the provincial gov't and the pnb before the regional trial court of marinduque. The case became even stronger when the court recently granted my motion to have the mayors of sta. cruz, boac, gasan and buenavista be impleaded as party plaintiffs. While the court did not extend the temporary restraining order it earlier granted, the joining of the 4 mayors, together with the actual filing of a direct action of the people via the referendum process with the comelec, served a strong notice to the pnb that their money could be in a very big trouble if they insist on proceeding with the loan transaction while these cases are pending. These are legal maneuvers intended to gain harder impact with least cost. I'd like to have a detailed discussion of this matter with you but I am now barred by what we term in law as the rule on sub judice. Be that as it may, rest assured that there's no letting up and we'll finish the job come what may. I know God will bless us because we are on the side of what is good and just.
